We’re heading to the voting booths on October 14 but do you know why a #voicetoparliament is important? Yes Leader Noel Pearson says it’s about ensuring the powers entrusted in our lawmakers are exercised without disadvantaging First Nations people which is something that stems from the 1967 Referendum. It was in this referendum that section 127 of The Constitution titled ‘Aborigines not to be counted in reckoning population’ was removed and section 51(xxvi) - the 'Races Power' was amended to include Aboriginal people. While this meant First Nations people could be counted in the census, it also gave the Parliament the ability to make laws affecting them. However, as held in the 1998 High Court Case of Kartinyeri v Commonwealth, this law making ability isn't strictly beneficial and it can be used to disadvantage members of a race.
